Our Services

DA Cheap Towing Company provides towing and roadside assistance services throughout the Dallas–Fort Worth, Texas area, subject to availability. Services may include, but are not limited to:

• Local and long-distance towing
• Flatbed towing
• Emergency roadside assistance
• Vehicle recovery
• Winch-out services
• Jump starts
• Battery-related assistance
• Flat tire changes
• Vehicle lockout assistance
• Fuel delivery
• Accident-related towing
• Light-duty and other authorized towing services
• Other transportation or roadside services agreed to at the time of service

Texas Towing Laws and Consumer Rights

Towing services in Texas may be subject to federal, state, county, municipal, and Texas Department of Licensing and Regulation ("TDLR") requirements. Different legal requirements may apply depending on the circumstances of a tow, including consent towing, incident-management towing, private-property towing, and other nonconsent towing.

If any provision of these Terms conflicts with a mandatory requirement of applicable law or regulation, the applicable law or regulation will control. Nothing in these Terms is intended to waive, restrict, or eliminate any consumer right that cannot legally be waived.

Authorization to Request Service

By requesting towing or roadside assistance, you represent that:

• You own the vehicle; or
• You are the vehicle operator; or
• You have possession, custody, or control of the vehicle; or
• You otherwise have lawful authority to authorize the requested service.

You are responsible for obtaining permission from the vehicle owner, rental company, employer, fleet owner, insurance company, lender, property owner, or other appropriate party when such permission is required. You agree not to request the towing, entry, movement, recovery, or transportation of a vehicle that you do not have legal authority to control.

DA Cheap Towing Company may request identification, vehicle information, registration information, proof of ownership, insurance information, or other documentation before performing or releasing a vehicle when appropriate or required by law.

Information You Provide

You agree to provide accurate and complete information when requesting service, including, when applicable:

• Vehicle year, make, and model
• Vehicle type and approximate weight
• Vehicle location
• Requested destination
• Nature of the breakdown or problem
• Whether the vehicle is damaged or disabled
• Whether wheels or tires are damaged, missing, or locked
• Whether the steering system is locked or damaged
• Whether the vehicle is AWD, 4WD, electric, hybrid, lowered, lifted, modified, or has special components
• Whether the vehicle is off-road, in a parking structure, underground garage, ditch, mud, restricted area, or other unusual location
• Any known safety hazards
• Any other information reasonably necessary to determine appropriate equipment and service

Quotes, Estimates, and Pricing

Prices or quotes provided by telephone, text message, website, advertisement, email, or dispatcher are generally estimates based on the information available at the time, unless expressly identified as a guaranteed fixed price. The final price may change based on actual conditions encountered at the service location.

Factors That May Affect Final Price

• Vehicle size, weight, and type
• Distance and loaded mileage traveled
• Vehicle condition or accident damage
• Recovery difficulty and winching requirements
• Number of operators or trucks required
• Special equipment or additional labor
• Roadside or off-road location, parking garage restrictions
• Weather or road conditions, after-hours service, holidays, waiting time
• Additional services requested or destination changes
• Incorrect or incomplete information provided by the customer
• Third-party expenses or authorized special services

Authorization of Additional Services

Conditions discovered after arrival may require additional labor, equipment, recovery procedures, mileage, or services. When reasonably possible, we will obtain authorization before performing material additional work that increases the quoted price.

In an emergency or safety-sensitive situation, certain actions may be necessary to protect people, property, the vehicle, the roadway, or our equipment. Those situations may be governed by applicable law or instructions from law enforcement or other authorities.

Payment

Unless other arrangements have been approved in writing, payment is due when the service is completed or at another time communicated to you before or during service. Accepted payment methods may include:

• Credit cards
• Debit cards
• Cash
• Electronic payments
• Other payment methods approved by DA Cheap Towing Company

Available payment methods may vary depending on the service or circumstances. By providing a payment method, you represent that you are authorized to use that payment method and authorize DA Cheap Towing Company to charge the approved service amount and any additional charges you subsequently authorize. You are responsible for applicable taxes, authorized tolls, parking charges, third-party expenses, or other lawful charges associated with the service.

Billing Questions and Payment Disputes

If you believe a billing error occurred, please contact us promptly so that we can investigate the matter. A payment dispute or chargeback does not automatically eliminate an otherwise valid payment obligation for services that were properly requested, authorized, and performed.

Nothing in these Terms prevents a customer from exercising any lawful rights available through a bank, payment-card issuer, payment network, government agency, or applicable consumer-protection law.

We may retain service authorizations, photographs, communications, GPS information, invoices, receipts, work orders, and other service records for purposes including responding to billing disputes, insurance matters, customer complaints, or legal requirements.

Dispatch and Estimated Arrival Times

Any estimated time of arrival ("ETA") provided by DA Cheap Towing Company is an estimate only and is not guaranteed. Actual arrival times may be affected by:

• Traffic, road closures, accidents, weather, or construction
• Driver, distance, or equipment availability
• Previous service calls or law-enforcement activity
• Incorrect location information
• Unexpected operational conditions or circumstances beyond our reasonable control

Cancellation and Dispatch Fees

You may cancel a service request by contacting us as soon as possible. If you cancel before a driver or service provider has been dispatched, a cancellation fee will generally not be charged unless a reservation, special equipment, or another non-refundable charge was clearly disclosed and accepted in advance. Once a driver, truck, or service provider has been dispatched, a dispatch or cancellation fee may apply.

A Dispatch or Cancellation Fee May Also Apply When

• The customer cancels after dispatch or leaves the location
• The vehicle is no longer at the reported location, or the customer cannot be reached
• The customer provides an incorrect location
• Another company services the vehicle after we have been dispatched
• The customer refuses the authorized service after arrival
• Access to the vehicle is unavailable
• Material information about the vehicle or situation was not disclosed

Any fee remains subject to applicable law and any required disclosures.

Customer Availability

You or another authorized person should remain available by telephone while service is being dispatched and performed. If we cannot reach you after reasonable attempts, we may delay or cancel the service. You are responsible for providing safe and lawful access to the vehicle.

Vehicle Condition and Pre-Existing Damage

Towing and roadside services frequently involve vehicles that are already damaged, mechanically compromised, disabled, involved in accidents, or located in difficult conditions. DA Cheap Towing Company is not responsible for damage that existed before our service or that was caused by a pre-existing condition, including:

• Accident, structural, or suspension damage
• Mechanical, transmission, drivetrain, steering, or electrical problems
• Manufacturer defects, rust, corrosion, or deteriorated components
• Previously cracked, loose, or damaged body components, trim, or accessories
• Aftermarket modifications or improperly installed accessories
• Existing fluid leaks or conditions not reasonably visible to the towing operator

Lowered, Modified, Exotic, and Special Vehicles

Vehicles with low ground clearance, aftermarket body kits, lowered suspension, oversized wheels, modified suspension, damaged components, or other nonstandard characteristics may present additional towing risks. You must notify us of such conditions before dispatch whenever reasonably possible. We may require specialized equipment or techniques, and additional charges may apply. We may refuse to move a vehicle when our operator reasonably determines that doing so would create an unreasonable risk of damage or injury.

Electric, Hybrid, AWD, and 4WD Vehicles

Certain vehicles require manufacturer-specific towing methods. Customers should accurately identify electric vehicles, hybrids, all-wheel-drive vehicles, four-wheel-drive vehicles, and vehicles with special towing requirements when requesting service. We will use reasonable towing practices based on available vehicle information and conditions at the scene.

Roadside Assistance Is Not a Repair Guarantee

Roadside assistance is intended primarily to help address an immediate roadside situation. A jump start, tire change, fuel delivery, lockout service, temporary adjustment, or other roadside assistance does not guarantee that the vehicle is mechanically safe, fully repaired, or able to continue operating. For example:

• A successful jump start does not establish that the battery, alternator, starter, or electrical system is functioning properly
• A tire change does not establish that the remaining tires, wheel, suspension, or spare tire are safe
• Fuel delivery does not guarantee that a no-start condition is caused by lack of fuel
• Unlocking a vehicle does not constitute a warranty regarding locks, windows, weather stripping, electronics, or security systems

Customers should obtain appropriate inspection or repair from a qualified automotive professional when needed.

Vehicle Recovery and Winching

Winch-outs and recovery services may involve additional risks because of terrain, vehicle position, accident damage, mud, water, slopes, ditches, barriers, unstable surfaces, or other circumstances. Recovery pricing may differ from ordinary towing rates. We may stop or decline a recovery operation if our operator determines that it cannot be safely completed with available personnel or equipment. Additional equipment or assistance may be required and may result in additional charges when authorized or legally permitted.

Vehicle Destination

You are responsible for providing an accurate and lawful towing destination unless the destination is determined by law enforcement, applicable law, insurance arrangements, or other authorized instructions. You are responsible for confirming that the destination:

• Is open or accessible and accepts the vehicle
• Permits after-hours delivery, if applicable
• Has sufficient space for delivery
• Is authorized to receive the vehicle

Additional mileage, waiting time, redelivery, or other charges may apply if the requested destination cannot accept the vehicle and another destination must be selected.

Keys and Vehicle Access

You are responsible for providing vehicle keys or appropriate access when necessary. Certain services may be more difficult or impossible when keys are unavailable, steering is locked, the transmission cannot be placed in neutral, electronic systems are inoperative, wheels are locked, parking brakes cannot be released, or the vehicle cannot be safely accessed. Additional equipment or labor may be required.

Personal Property

Customers should remove cash, jewelry, electronics, documents, firearms, medication, tools, merchandise, and other valuable or sensitive property before towing whenever reasonably possible. DA Cheap Towing Company is not a storage or safekeeping service for personal property contained inside a vehicle. We are not responsible for loss of personal property that we did not take into our possession, except to the extent responsibility is imposed by applicable law. Separate rules may apply when a vehicle is delivered to a vehicle storage facility.

Photographs and Service Documentation

Where appropriate, DA Cheap Towing Company may photograph or otherwise document vehicle condition, existing damage, vehicle position, service location, towing or recovery setup, completed work, odometer or identifying information, and relevant conditions at the service location. Such records may be used for quality control, service documentation, insurance matters, billing disputes, fraud prevention, complaint investigations, and legal or regulatory compliance.

Safety

Customers and bystanders must remain a safe distance from tow trucks, cables, winches, traffic lanes, moving vehicles, and operating equipment. You agree to follow reasonable safety instructions provided by the towing operator. Our drivers may suspend or refuse service where a customer, passenger, bystander, location, weather condition, traffic situation, or other circumstance creates an unreasonable safety risk.

Third-Party and Authorized Service Providers

Where permitted by law and applicable to the requested service, DA Cheap Towing Company may use employees, authorized operators, vendors, subcontractors, affiliates, or other qualified service providers in connection with fulfilling a service request. Any provider performing regulated towing services must satisfy applicable licensing, permitting, insurance, and regulatory requirements applicable to that service.

Circumstances Beyond Our Control

DA Cheap Towing Company is not responsible for delay or inability to perform caused by circumstances beyond our reasonable control, including severe weather, flooding, road closures, traffic congestion, accidents, government or law-enforcement actions, natural disasters, equipment failure despite reasonable maintenance, communications or cellular-network outages, power failures, civil emergencies, restricted access, unsafe conditions, or other events that could not reasonably have been prevented.

Website Use

You agree not to:

• Use our website for unlawful or fraudulent purposes
• Submit false service requests or impersonate another person
• Attempt to gain unauthorized access to our website, servers, systems, or accounts
• Introduce viruses, malware, harmful code, or automated attacks
• Interfere with website functionality
• Scrape or systematically extract website content without authorization
• Copy or commercially exploit protected content without permission
• Use our website in a manner that violates applicable law

We may restrict access to our website when reasonably necessary to protect our systems or users.

• A specific arrival time or continuous website availability
• That every requested service will be available
• That roadside assistance will permanently repair a mechanical condition
• That a disabled or damaged vehicle can be moved without the risks inherent in its existing condition
• That information supplied by third parties will always be accurate

Limitation of Liability

To the fullest extent permitted by applicable law, DA Cheap Towing Company and its owners, employees, representatives, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages resulting from use of the website or services, including lost profits, lost income, lost business opportunities, loss of use, or similar economic losses.

Claims Concerning Vehicle Damage

If you believe your vehicle was damaged during our service, please contact DA Cheap Towing Company as soon as reasonably possible. Prompt notice allows us to review pre- and post-service photographs, tow-truck records, GPS information, driver documentation, work orders, communications, video evidence, and other relevant information. When possible, please provide photographs, repair estimates, and an explanation of the claimed damage.

A request for prompt notification does not shorten any legal limitation period or eliminate rights provided by applicable law.

Indemnification

To the extent permitted by law, you agree to indemnify and hold DA Cheap Towing Company harmless from third-party claims, losses, or expenses resulting from your unlawful use of our website or services, materially false information you provide, your lack of legal authority to order a service, your violation of another person's property rights, or your violation of these Terms or applicable law.

Refund and Cancellation Policy

Our separate Refund and Cancellation Policy is incorporated into these Terms by reference. Completed towing and roadside services are generally final and non-refundable, except where a refund, reimbursement, adjustment, or other remedy is required by law or approved under our Refund and Cancellation Policy.

Promotions and Discounts

Promotional discounts, coupons, or special offers are subject to their stated terms, may have expiration dates, may be limited to specific services, may not be combined unless expressly stated, have no cash value, may not apply to regulated charges where prohibited, and may be modified or discontinued as permitted by law. A promotion does not modify these Terms unless expressly stated.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where federal law applies. Any legal proceeding concerning these Terms or our services must be brought in a court having proper jurisdiction and venue under applicable law.

No Waiver of Mandatory Consumer Rights

Nothing in these Terms is intended to waive any right, remedy, warranty, protection, hearing right, complaint right, or statutory protection that cannot legally be waived. If applicable law provides greater protection than these Terms, applicable law controls.

Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permitted, and the remaining provisions will remain in effect.

No Waiver

Our failure to enforce any provision of these Terms on one occasion does not constitute a waiver of our right to enforce that provision or another provision in the future.

Entire Agreement

These Terms, together with any applicable service authorization, estimate, invoice, work order, Refund and Cancellation Policy, Privacy Policy, and other written agreement applicable to a particular service, constitute the agreement between you and DA Cheap Towing Company concerning the applicable website use or service. If a separately signed service agreement contains terms that conflict with these Terms, the separately signed agreement will control to the extent permitted by law.

Electronic Communications and Acceptance

When you communicate with us electronically, submit an online form, approve a service electronically, respond affirmatively to an authorization request, or otherwise agree to conduct a transaction electronically, you consent to receiving related communications electronically to the extent permitted by law. Electronic records, approvals, and signatures may be used to document your service authorization and agreement where legally permitted.

Changes to These Terms

We may revise these Terms from time to time. The revised version will be posted on our website with an updated "Last Updated" date. Unless otherwise required by law, revisions apply prospectively after they are posted and do not retroactively change the terms applicable to a completed transaction.
