Towing services in Texas may be subject to federal, state, county, municipal, and Texas Department of Licensing and Regulation ("TDLR") requirements. Different legal requirements may apply depending on the circumstances of a tow, including consent towing, incident-management towing, private-property towing, and other nonconsent towing.
If any provision of these Terms conflicts with a mandatory requirement of applicable law or regulation, the applicable law or regulation will control. Nothing in these Terms is intended to waive, restrict, or eliminate any consumer right that cannot legally be waived.
By requesting towing or roadside assistance, you represent that:
You are responsible for obtaining permission from the vehicle owner, rental company, employer, fleet owner, insurance company, lender, property owner, or other appropriate party when such permission is required. You agree not to request the towing, entry, movement, recovery, or transportation of a vehicle that you do not have legal authority to control.
DA Cheap Towing Company may request identification, vehicle information, registration information, proof of ownership, insurance information, or other documentation before performing or releasing a vehicle when appropriate or required by law.
You agree to provide accurate and complete information when requesting service, including, when applicable:
Prices or quotes provided by telephone, text message, website, advertisement, email, or dispatcher are generally estimates based on the information available at the time, unless expressly identified as a guaranteed fixed price. The final price may change based on actual conditions encountered at the service location.
Conditions discovered after arrival may require additional labor, equipment, recovery procedures, mileage, or services. When reasonably possible, we will obtain authorization before performing material additional work that increases the quoted price.
In an emergency or safety-sensitive situation, certain actions may be necessary to protect people, property, the vehicle, the roadway, or our equipment. Those situations may be governed by applicable law or instructions from law enforcement or other authorities.
Unless other arrangements have been approved in writing, payment is due when the service is completed or at another time communicated to you before or during service. Accepted payment methods may include:
Available payment methods may vary depending on the service or circumstances. By providing a payment method, you represent that you are authorized to use that payment method and authorize DA Cheap Towing Company to charge the approved service amount and any additional charges you subsequently authorize. You are responsible for applicable taxes, authorized tolls, parking charges, third-party expenses, or other lawful charges associated with the service.
If you believe a billing error occurred, please contact us promptly so that we can investigate the matter. A payment dispute or chargeback does not automatically eliminate an otherwise valid payment obligation for services that were properly requested, authorized, and performed.
Nothing in these Terms prevents a customer from exercising any lawful rights available through a bank, payment-card issuer, payment network, government agency, or applicable consumer-protection law.
We may retain service authorizations, photographs, communications, GPS information, invoices, receipts, work orders, and other service records for purposes including responding to billing disputes, insurance matters, customer complaints, or legal requirements.
Any estimated time of arrival ("ETA") provided by DA Cheap Towing Company is an estimate only and is not guaranteed. Actual arrival times may be affected by:
You may cancel a service request by contacting us as soon as possible. If you cancel before a driver or service provider has been dispatched, a cancellation fee will generally not be charged unless a reservation, special equipment, or another non-refundable charge was clearly disclosed and accepted in advance. Once a driver, truck, or service provider has been dispatched, a dispatch or cancellation fee may apply.
Any fee remains subject to applicable law and any required disclosures.
You or another authorized person should remain available by telephone while service is being dispatched and performed. If we cannot reach you after reasonable attempts, we may delay or cancel the service. You are responsible for providing safe and lawful access to the vehicle.
Towing and roadside services frequently involve vehicles that are already damaged, mechanically compromised, disabled, involved in accidents, or located in difficult conditions. DA Cheap Towing Company is not responsible for damage that existed before our service or that was caused by a pre-existing condition, including:
Vehicles with low ground clearance, aftermarket body kits, lowered suspension, oversized wheels, modified suspension, damaged components, or other nonstandard characteristics may present additional towing risks. You must notify us of such conditions before dispatch whenever reasonably possible. We may require specialized equipment or techniques, and additional charges may apply. We may refuse to move a vehicle when our operator reasonably determines that doing so would create an unreasonable risk of damage or injury.
Certain vehicles require manufacturer-specific towing methods. Customers should accurately identify electric vehicles, hybrids, all-wheel-drive vehicles, four-wheel-drive vehicles, and vehicles with special towing requirements when requesting service. We will use reasonable towing practices based on available vehicle information and conditions at the scene.
Roadside assistance is intended primarily to help address an immediate roadside situation. A jump start, tire change, fuel delivery, lockout service, temporary adjustment, or other roadside assistance does not guarantee that the vehicle is mechanically safe, fully repaired, or able to continue operating. Customers should obtain appropriate inspection or repair from a qualified automotive professional when needed.
Winch-outs and recovery services may involve additional risks because of terrain, vehicle position, accident damage, mud, water, slopes, ditches, barriers, unstable surfaces, or other circumstances. Recovery pricing may differ from ordinary towing rates. We may stop or decline a recovery operation if our operator determines that it cannot be safely completed with available personnel or equipment. Additional equipment or assistance may be required and may result in additional charges when authorized or legally permitted.
You are responsible for providing an accurate and lawful towing destination unless the destination is determined by law enforcement, applicable law, insurance arrangements, or other authorized instructions. You are responsible for confirming that the destination:
Additional mileage, waiting time, redelivery, or other charges may apply if the requested destination cannot accept the vehicle and another destination must be selected.
You are responsible for providing vehicle keys or appropriate access when necessary. Certain services may be more difficult or impossible when keys are unavailable, steering is locked, the transmission cannot be placed in neutral, electronic systems are inoperative, wheels are locked, parking brakes cannot be released, or the vehicle cannot be safely accessed. Additional equipment or labor may be required.
Customers should remove cash, jewelry, electronics, documents, firearms, medication, tools, merchandise, and other valuable or sensitive property before towing whenever reasonably possible. DA Cheap Towing Company is not a storage or safekeeping service for personal property contained inside a vehicle. We are not responsible for loss of personal property that we did not take into our possession, except to the extent responsibility is imposed by applicable law. Separate rules may apply when a vehicle is delivered to a vehicle storage facility.
Where appropriate, DA Cheap Towing Company may photograph or otherwise document vehicle condition, existing damage, vehicle position, service location, towing or recovery setup, completed work, odometer or identifying information, and relevant conditions at the service location. Such records may be used for quality control, service documentation, insurance matters, billing disputes, fraud prevention, complaint investigations, and legal or regulatory compliance.
Customers and bystanders must remain a safe distance from tow trucks, cables, winches, traffic lanes, moving vehicles, and operating equipment. You agree to follow reasonable safety instructions provided by the towing operator. Our drivers may suspend or refuse service where a customer, passenger, bystander, location, weather condition, traffic situation, or other circumstance creates an unreasonable safety risk.
Where permitted by law and applicable to the requested service, DA Cheap Towing Company may use employees, authorized operators, vendors, subcontractors, affiliates, or other qualified service providers in connection with fulfilling a service request. Any provider performing regulated towing services must satisfy applicable licensing, permitting, insurance, and regulatory requirements applicable to that service.
DA Cheap Towing Company is not responsible for delay or inability to perform caused by circumstances beyond our reasonable control, including severe weather, flooding, road closures, traffic congestion, accidents, government or law-enforcement actions, natural disasters, equipment failure despite reasonable maintenance, communications or cellular-network outages, power failures, civil emergencies, restricted access, unsafe conditions, or other events that could not reasonably have been prevented.

When possible, please provide photographs, repair estimates, and an explanation of the claimed damage.
A request for prompt notification does not shorten any legal limitation period or eliminate rights provided by applicable law.

If a separately signed service agreement contains terms that conflict with these Terms, the separately signed agreement will control to the extent permitted by law.
When you communicate with us electronically, submit an online form, approve a service electronically, respond affirmatively to an authorization request, or otherwise agree to conduct a transaction electronically, you consent to receiving related communications electronically to the extent permitted by law.
